These Terms of Service govern the use of this website and the purchase of products from Emerson Laine, an independent author based in New Zealand. I may update these Terms of Service from time to time to reflect changes to my business, legal requirements, or the services offered through this website.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
1. Acceptance of Terms: By accessing this website and purchasing products, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use this website or purchase any products.
2. The Contract of Sale: When you place an order, you are making an offer to purchase products under these terms. A binding contract is formed only when I accept your order, typically indicated by a confirmation email containing your download link or order details. I reserve the right to decline or cancel an order prior to fulfilment where necessary, including where pricing errors, technical issues, suspected fraud, or product availability issues occur. If this happens after payment has been taken, you will receive a refund.
3. Digital Products (Ebooks & Audiobooks)
- Delivery: Digital products are delivered via BookFunnel. By purchasing, you acknowledge that you are responsible for providing a correct email address and ensuring your device is compatible with the file formats provided.
- Usage Rights: All digital products are for your personal, non-commercial use only. You may not sell, distribute, modify, or share these files with others. The copyright remains with the author. Your purchase grants you a personal, non-exclusive, non-transferable licence to access and use the digital product for your own personal, non-commercial use.
- Refunds: Due to the nature of digital products, all sales are final once the product has been delivered or made available for download. I do not provide refunds for a change of mind. If you experience a genuine technical fault, please contact me within 14 days of purchase.
4. Physical Products (Print-on-Demand)
- Fulfillment: Physical books are printed and shipped via third-party providers. By purchasing, you authorise the transfer of your shipping information to these providers solely for the purpose of fulfilling your order.
- Shipping: Delivery estimates are provided in good faith but are not guaranteed. Delivery times may vary depending on destination, customs processing, postal services, and other circumstances beyond my control.
- Returns & Defects: I do not accept returns for change of mind. If your book arrives damaged or contains a manufacturing defect, please contact me within 14 days of delivery with photographic evidence. Where appropriate, I will arrange a replacement or other remedy in accordance with applicable consumer laws.
5. Pricing and Currency: All prices are displayed in NZD unless otherwise stated. If your payment method is in a different currency, your bank or payment processor may apply their own exchange rate and transaction fees. I am not responsible for these additional charges. Prices may or may not include applicable taxes depending on your location. Where required, taxes will be calculated and displayed during checkout.
6. Intellectual Property: All content on this website, including text, logos, graphics, images, book covers, artwork, and other original content, is my intellectual property. You may not use, reproduce, or distribute any material from this site without my express written permission.
7. Limitation of Liability: Nothing in these Terms limits or excludes any rights or remedies that cannot be excluded under applicable consumer protection laws. I am not liable for any indirect, incidental, or consequential damages resulting from the use of this website or the products sold here. To the fullest extent permitted by law, my total liability to you for any claim arising out of or relating to these Terms or your purchase shall not exceed the amount you paid for the relevant product.
8. Governing Law: These Terms are governed by the laws of New Zealand, except where mandatory consumer protection laws in your country of residence apply.
9. Accuracy of Information: I make reasonable efforts to ensure product descriptions, pricing and other information are accurate. However, I reserve the right to correct errors or omissions at any time, including after an order has been placed, provided your rights under applicable consumer laws are not affected.
10. Third Party Services: Certain services available through this website are provided by third parties, including payment processing, ebook delivery and print fulfilment providers. While I am not responsible for outages, delays or interruptions caused by services beyond my reasonable control, nothing in these Terms limits your rights under applicable consumer protection laws. This website may also contain links to third party websites for your convenience. I am not responsible for the content, availability or privacy practices of those websites.
11. Force Majeure: I am not responsible for delays or failure to perform my obligations where such delays result from events beyond my reasonable control, including natural disasters, internet outages, postal disruptions, cyber incidents, or actions of government authorities.
